មជ្ឈមណ្ឌលសិទ្ធិមនុស្សកម្ពុជាបានសម្ដែងក្តីព្រួយបារម្ភជាខ្លាំងអំពីក្រមព្រហ្មទណ្ឌថ្មីដែលសភាទើបបានអនុម័តកាលពីពេលថ្មីៗនេះថា នឹងនាំឲ្យមានបញ្ហាគ្រោះថ្នាក់ធ្ងន់ធ្ងរដល់សិទ្ធិសេរីភាពនៃការបញ្ចេញមតិដែលត្រូវបានការពារដោយរដ្ឋធម្មនុញ្ញខ្មែរ។

ក្នុងសេចក្តីថ្លែងការណ៍៣ទំព័រចុះថ្ងៃទី១៦ តុលា ឆ្នាំ២០០៩នេះ មជ្ឈមណ្ឌលសិទ្ធិមនុស្សកម្ពុជាបានលើកឡើងនូវចំណុចព្រួយបារម្ភនៃច្បាប់ព្រហ្មទណ្ឌថ្មី ពីព្រោះថា ច្បាប់នេះបានកំណត់ឲ្យមានការដាក់ទោសជាបទឧក្រិដ្ឋកម្មចំពោះបទបរិហារកេរ្តិ៍, និយមន័យនៃខ្លឹមសារជាច្រើនមាត្រាមានភាពមិនច្បាស់លាស់ និងមានភាពទំលំទូលាយ ដែលអាចនាំឲ្យមានការបកស្រាយខុសនិងអនុវត្តច្បាប់នេះដោយបំពាន ហើយអ្វីដែលជាការព្រួយបារម្ភមួយទៀតគឺកម្រិតទោសទណ្ឌធ្ងន់ហួសហេតុ និងការដាក់ទម្ងន់ទោសដូចគ្នាចំពោះអ្នកដែលប៉ុនប៉ងប្រព្រឹត្តបទឧក្រិដ្ឋនិងអ្នកដែលប្រព្រឹត្តបទឧក្រិដ្ឋបានសម្រេច។
អាស្រ័យដូចបានបញ្ជាក់ខាងលើនេះ មជ្ឈមណ្ឌលសិទ្ធិមនុស្សកម្ពុជាស្នើសុំឲ្យរាជរដ្ឋាភិបាលខ្មែរដកចេញនូវបទល្មើសទាក់ទងនឹងបទបរិហារកេរ្តិ៍ពីក្រមព្រហ្មទណ្ឌដើម្បីធ្វើឲ្យច្បាប់ជាតិមានលំនាំស្របតាមច្បាប់អន្តរជាតិ។
មជ្ឈមណ្ឌលសិទ្ធិមនុស្សកម្ពុជាមានជំនឿថា ការដែលច្បាប់នេះមាននិយមន័យមិនច្បាស់លាស់និងទំលំទូលាយនេះ នោះគឺជាការបើកឱកាសឲ្យតុលាការខ្មែរបកស្រាយខុសនិងរំលោភបំពានលើច្បាប់។ បន្ថែមពីនេះមជ្ឈមណ្ឌលសិទ្ធិមនុស្សកម្ពុជាសូមអំពាវនាវសុំឲ្យរាជរដ្ឋាភិបាលខ្មែរពិចារណាឡើងវិញអំពីសិទ្ធិមនុស្សនិងសិទ្ធិសេរីភាពនៃការបញ្ចេញមតិដែលជាគោលដៅចម្បងនៃលទ្ធិប្រជាធិបតេយ្យ៕

អ្នកអាចបញ្ចេញមតិដោយបំពេញទម្រង់ខាងក្រោមនេះក្នុងទម្រង់ជាអក្សរសុទ្ធ។. មតិត្រូវតែអនុញ្ញាតដោយអ្នកសម្របសម្រួលនិងមិនបង្ហាញភ្លាមៗនៅលើទំព័រនេះទេ។ សូមអញ្ជើញត្រឡប់មកបើកទំព័រនេះម្ដងទៀតដើម្បីមើលថាតើមតិរបស់អ្នកត្រូវបានចុះផ្សាយឬអត់។
i concern in new law, but more importantly with the people whos translated the law. most of the translaters translated not to the intend of the law writers.

It is an excellent suggestion that the article on defamation, libel, and slander be withdrawn from the draft criminal codes. I could'nt agree more that it will rather harm the powerless than help, and those bunch of incompetent judges are just mouthpiece of the powerful, and serve no justice at all for the poor. I remembered overhearing folks who work in an enforcement unit of a ministry usually say that everytime there is new law or statute, it would be a great opportunity to make money. It is really really a travesty of justice!

I would express many thanks to NGO concern over a new passed penalty code. This new law is showing a very small gate of rights to express opinoin.

It would be better to take this article out of this law because it is not necessary. The inclusion of this article about libel or slander in the law will not make safety and security in the life of the people if there is bad interpretation of the law by the judge to favor any party to the conflict. So the incorporation of the article about defamation, libel and slander won't solve any problem in our Khmer society. It will create more problems in our Khmer society than solve them, and the freedom of speech of the people will be affected and deteriorated. No one will express his or her opinion about anything because his or her statement eithet spoken or written might be cause of defamation against someone else. Therefore,a real democracy will never happen in Cambodia as expected and the rule of law will serve only those in power and those who have strong financial position, not the powerless and the poorest victims.

I strongly commend the courage and stamina of the Human Right Center in their fight for the true resepct of human rights and freedom of expression in Cambodia. It would have been worse without your fight. By the way, have you thought about a petition where people who could not come to demonstrate can sign and submit to the national assembly; and most importantly, to the donor countries when they meet to decide the amount of aides to Cambodia. You might have already pursued this venue; it is a suggestion, though. Keep up your good work!
