The Communist regime's view of law combines traditional Chinese authoritarian legalism and Marxist-Leninism's views that the law is an instrument that defends the interests of the ruling strata, namely the Communist Party (actually an interest group more than a political party since it does not allow any other bona fide political parties to exist in China). This CCP understanding of legalism lacks any concept of law as an instrument to prevent the state's encroachment or violation of basic individual rights or liberties. Law is a top down instrument of the Party rulers, who are above the law.
